The principal signs, not the agent. The person giving the power must be present, identified and signing willingly. The agent does not need to attend unless the document asks for their signature too.

Does a power of attorney need to be notarized in Texas?

A Texas statutory durable power of attorney must be signed before a notary to be effective under the Estates Code, and a medical power of attorney is signed either before a notary or two qualified witnesses. Your attorney or the form's instructions will say which applies to your document.

Can you prepare the power of attorney for me?

No. A Texas notary cannot draft documents, choose forms or explain their legal effect. Use a form from your attorney, your bank or the official Texas statutory form, fill it in completely, and bring it unsigned.

Can the power of attorney be notarized online?

Often, yes. Online notarization is $35 per notarized signature with no travel fee, and the signer can be anywhere. If the agent's bank or another office insists on a wet-ink original, choose an in-person visit instead.

What if my parent is in the hospital or has memory loss?

I can come to the hospital or care community. The signer must understand what they are signing and be signing willingly at the time of the appointment. If that is uncertain, it is worth talking with the doctor and an attorney before booking.
